PLEASE NOTE: **** Once we have received your Booking we will send you an Invoice with instructions on how to pay online. We also accept payment via bank transfers. Please be aware there will be an additional fee for international bank transfers, which will vary depending on your physical location and bank. Once you fill in the form on the bookings page and we have confirmed your trip, we will email you our bank account details for the transfer.


The terms and conditions herewith will refer to the person(s) making a booking as the “Guest” or “Guests”, and the establishment (Trandie Marina Resorts Sdn Bhd), including its employees, as “Trandie Marina Resorts”, “We” or “Our”. Please read through the list below carefully as the list states Trandie Marina Resorts’ contractual rights and obligations to its Guests, as clearly as possible. Trandie Marina Resorts Sdn Bhd’s primary office and location of conducting business is located at Block J, Unit No. 2, 1st Floor, Jalan Batu Bersurat, Berakas, BB3395, Brunei Darussalam.

  1. Booking and Payment of Packages

    1. The total price shown on your booking form may not be the final price, and as such the final price will be quoted to you by invoice before you have entered your booking details and card details.
    2. A minimum charge of 2 Adults will be charged for each package.
    3. A single surcharge of BND 10/person will apply for any public holiday and/or weekend (Saturdays and Sundays) during your stay.
    4. All room upgrades are subject to availability.
    5. To ensure availability of rooms and packages, Trandie Marina Resorts requests that Guests make bookings a minimum of 21 days before your arrival date. All bookings are provisional until bookings are paid in full and Guests have received a confirmation of booking by email.
    6. All bookings of packages must be paid in full at least EITHER (i) 14 days in advance of package start date for overseas bookings OR (ii) 7 days in advance of package start date for local (within Brunei) bookings. Payments can be made either through credit card or by direct bank transfer (we will include our bank details in our invoice). Non-receipt of package payments by the stated due dates will result in bookings subject to cancellation at our discretion.
    7. Any add-ons or miscellaneous goods/services (e.g. refreshments) being purchased on site (i.e. not included in your package) from Trandie Marina Resorts will be settled in Brunei Dollar cash terms only.
    8. Please note that all packages will only cover transport starting from the Kianggeh (Bandar) jetty and ending back at the Kianggeh jetty, unless explicitly stated in the confirmation email.
  2. Changes & Amendments to Packages (including Special Requests)

    1. Where possible, Trandie Marina Resorts will do its best to accommodate any special requests by Guests. This includes (and is not limited to): meal requirements, physical disabilities, room requests, etc.
    2. Requests by Guests should be made during the booking process under the “Comments” section of the booking form.
    3. Should any changes be requested once the invoice has been issued and package has been paid for in full, Trandie Marina Resorts will do its best to accommodate the changes (accompanied with any relevant rate changes or extra charges). We however cannot guarantee that changes requested can be met. We will also issue a new invoice based on updated changes if made.
    4. Should we be unable to meet a Guest’s requests for changes post-payment, and the Guest decides to cancel their booking, then the booking will be subject to cancellation fees as below.
    5. Should any activities in a Guest’s package be unavailable on the day they are scheduled to occur, due to reasons beyond Our control (e.g. poor weather conditions), We reserve the right to substitute the original activity for other activity/activities at Our own discretion and also depending on the Guests preference. We are not responsible for any costs or expenses incurred by the Guest as a result of inconvenience suffered.
    6. If a Guest chooses to shorten their stay or check out early once their package has started, no refunds will be given.
  3. Cancellation Policies

    1. Any cancellation of packages by Guests should be done by email, addressed to
    2. Please note – cancellation of Guests’ packages will only be valid once we receive the Cancellation email from said Guest, and have sent confirmation of cancellation to said Guest’s email address.
    3. Cancellation fees are as below:

      3-7 days 50% of total package cost
      0-2 days 100% of total package cost
    4. Being unable to arrive on the starting day of the package will also be subject to the cancellation fee of the total package cost as well.
    5. Refunds of payments made by credit card, and issued based on cancellation of packages will take approximately 1-2 months to clear, based on processing time by our payment gateway. Should payments be made in cash, refunds can be picked up from our Batu Bersurat office. Should payments be made by bank transfer, refunds should take no longer than 2 weeks to process. Refunds made by bank transfer are subject to bank transfer fees.
    6. Trandie Marina Resorts reserves the right to cancel or modify reservations where it appears that a Guest has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error. We reserve the right to cancel or amend bookings if they do not adhere to Our terms & conditions.
  4. Force Majeure & Limitation of Liability

    1. Compensation or refunds will not be made for changes that arise as a result of situations outside of Our control, for example, cancellation of airline flights. When We refer to circumstances beyond our control, We mean any event that We could not foresee or avoid, even after taking all reasonable care.
    2. Such circumstances of Force Majeure will usually include, but are not limited to: war or threat of war, riots, terrorist activity, civil strife, strikes and other industrial disruption, technical problems with transport including changes imposed due to rescheduling or cancellation of flights by an airline or main charterer or alteration of the airline or aircraft type for reasons beyond Our control or that of Our suppliers; closed or congested airports or ports, Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster) or nuclear disasters, fire, quarantine, epidemics, health risks, actual or threatened severe weather conditions, Government action, change to Foreign Office advice to advise against travel to the Guests’ destination, significant building work on-going outside of the Guest’s accommodation (such as resort development) or other events beyond our control.
    3. Should a Force Majeure occur, We may have to change and/or terminate arrangements for Guests after departure. If this situation does occur, We regret that We will be unable to make any refunds, pay Guests compensation or meet any costs/expenses Guests may incur as a result.
    4. Notwithstanding anything contained in these Terms and Conditions to the contrary, Trandie Marina Resorts and its affiliates shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arisen out of the performance or non‑performance of obligations under this Terms and Conditions.
  5. Trandie Marina Resorts’ Responsibilities and Contractual Obligations to its Guests

    1. Should there be any service provided by Trandie Marina Resorts that is not reasonable or of sufficient standard to Guests, then Guests should notify Us immediately or as soon as possible, so that We may rectify the issues if and where possible. A written record of complaints should be kept by Guests. Once We have been notified, We will do everything reasonably possible to resolve said issue as soon as possible.
    2. Please note: Failure by Guests to notify Trandie Marina Resorts of any issues encountered while staying with Us, unfortunately results in Trandie Marina Resorts being unable to resolve with said issues and/or claims with Guests.
    3. Trandie Marina Resorts accepts responsibility should Guests encounter personal injury, illness, death, or other losses and damage as a direct result of inappropriate actions, lack of actions and/or behaviour of employees of Trandie Marina Resorts.
    4. Please note that Trandie Marina Resorts will not be liable for the following circumstances –
      1. Action(s) or lack of action(s) by said Guests affected,
      2. Action(s) or lack of action(s) by 3rd parties not affiliated with Trandie Marina Resorts,
      3. Circumstances or events beyond Our control, which could not have been avoided or foreseen even with all due diligence and care.
    5. Where Trandie Marina Resorts is found to have been directly liable and responsible for loss of/damage to Guests’ property or possessions, the maximum amount that We will pay per affected Guest is BND $30. As such, We recommend strongly that Guests buy travel insurance with sufficient and appropriate coverage before embarking on their package with Us.
    6. In the event of Guests suffering from injury, illness or sickness, Trandie Marina Resorts will offer reasonable assistance, at its own discretion.
  6. Guest Behaviour & Responsibilities

    1. All guests staying at the resort are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other guests. If in Trandie Marina Resort’s opinion or in the opinion of any hotel manager or any other person in authority, the Guests’ behaviour or that of any member of the party is causing or is likely to cause distress, danger or annoyance to any of the other guests or any third party or damage to property, Trandie Marina Resorts reserves the right to terminate the concerned Guests’ holiday arrangements with the resort immediately. In the event of such termination Trandie Marina Resorts’ liability to the Guests and/or the party will cease and the Guests will be required to leave their accommodation or other service immediately. Trandie Marina Resorts will have no further obligations to the Guests and the rest of the party. No refunds for lost accommodation or any other service will be made and Trandie Marina Resorts will not pay any expenses or costs incurred as a result of termination. The Guests may also be required to pay for loss and/or damage caused by their actions. Trandie Marina Resorts will hold the Guest and each member of the party jointly and individually liable for any damage or loss caused by the Guest or any member of the party. Full payment for any such damage or loss must be paid direct to the hotel manager or other supplier prior to departure from the resort. If the Guest fails to make payment, he/she will be responsible for meeting any claims (including legal costs) subsequently made against Us as a result of the Guest’s actions together with all cost the resort will incur in pursing any claim against the Guest. Trandie Marina Resorts cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with the Guest’s holiday arrangements with Trandie Marina Resorts.
      1. Any unresolved dispute or controversy arising under or in connection with the services provided by Trandie Marina Resorts shall be settled exclusively by arbitration, conducted before the “do we have any” Association in Brunei Darussalam, in accordance with the rules of that body then in effect.
      2. The arbitrator shall not have the authority to add to, detract from, or modify any provision hereof nor to award punitive damages to any injured party. A decision by the arbitrator shall be final and binding. Judgment may be entered on the arbitrator's award in any court having jurisdiction. Each party shall be responsible for the respective fees and expenses of their legal representation and the costs of arbitration shall be shared equally.
      3. Legal proceedings against Trandie Marina Resorts may be instituted only in a state or federal court within the Country, and any claim involved in such proceedings shall be decided in accordance with the laws of Brunei Darussalam. Any legal proceeding against Trandie Marina Resorts must be commenced within one year following the date of tour completion. Neither Trandie Marina Resorts nor any affiliate shall in any case be liable for other than compensatory damages, and Guests hereby waive any right to punitive damages.
